Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Nutrina mobile application (the "Service") operated by Nutrina ("we", "our", or "us").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 16 years old in the European Union or at least 13 years old in other regions to use the Service. If you are under the age of 18, you must have parental or legal guardian consent to use the Service. By using the Service, you represent that you meet these age requirements.

3. Description of Service

Nutrina is a nutrition tracking application that uses artificial intelligence to analyze food images and provide nutritional information. The Service includes:

• AI-powered food image analysis and nutritional breakdown.
• Manual food entry and nutrition logging.
• Nutrition history tracking and trend analysis.
• Personalized dietary insights and recommendations.
• AI nutrition assistant for food-related questions.

4. Subscriptions and Payments

4.1 Subscription Plans

The Service offers both free and premium subscription plans. Premium plans provide additional features such as increased AI analysis limits and advanced nutritional insights. Details of available plans and pricing are displayed within the app.

4.2 Free Trial

We may offer a free trial period for premium features. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. The trial duration is specified at the time of sign-up.

4.3 Billing and Auto-Renewal

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• Prices are displayed in your local currency and may vary by region.

4.4 Managing and Canceling Subscriptions

• iOS: Go to Settings > Apple ID > Subscriptions > Nutrina > Cancel.
• Android: Go to Google Play Store > Menu > Subscriptions > Nutrina > Cancel.

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.

4.5 Refunds

• All purchases are processed through Apple App Store or Google Play Store.
• Refund requests must be directed to Apple or Google, as they handle all payment processing.
• Apple: Request a refund at reportaproblem.apple.com.
• Google Play: Request a refund through Google Play Store > Order history, or contact Google Play support.
• Refund eligibility is determined by Apple's or Google's refund policies.

5. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content that is harmful, offensive, or violates the rights of others.
• Attempt to reverse-engineer, decompile, or disassemble the Service.
• Interfere with or disrupt the Service or its servers.
• Use automated systems (bots, scrapers) to access the Service.
• Share your account credentials with others.
• Circumvent usage limits or subscription restrictions.

7. AI-Generated Content Disclaimer

The nutritional information provided by our AI analysis is for informational purposes only. Important disclaimers:

• AI-generated nutritional data may not be 100% accurate and should not be solely relied upon for medical or dietary decisions.
• The Service is not a substitute for professional medical or nutritional advice.
• Consult a healthcare professional before making significant dietary changes, especially if you have allergies, medical conditions, or dietary restrictions.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated nutritional information.

8. Intellectual Property

The Service and its original content (excluding user-provided content) are owned by Nutrina and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you upload to the Service.

9. User Content

By uploading content (such as food photos) to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze the content solely for the purpose of providing the Service to you. This includes transmitting your food photos to AI service providers for nutritional analysis. We will not use your content for any other purpose without your consent.

10. Usage Limits

The Service imposes limits on AI analysis usage (e.g., daily scan limits). These limits vary based on your subscription plan. Free users receive a limited number of AI analyses per day. We reserve the right to modify usage limits at any time with reasonable notice.

11. Termination

We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time through the app settings. Upon account deletion:

• Your personal data will be deleted within 30 days.
• Active subscriptions are not automatically canceled — you must cancel through Apple or Google before deleting your account.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Nutrina shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use.
• Health consequences arising from reliance on AI-generated nutritional information.
• Service interruptions or data loss.
• Unauthorized access to your account.

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable law, including consumer protection laws in Turkey and the European Union.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms or the use of the Service shall be resolved as follows:

• For disputes up to the consumer arbitration threshold: Consumer Arbitration Committees (Tuketici Hakem Heyeti) in Turkey.
• For disputes above the threshold: Istanbul Courts and Enforcement Offices shall have exclusive jurisdiction.
• EU residents retain the right to bring claims in their country of residence under applicable EU consumer protection laws.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page, updating the "Last updated" date, and sending a notification through the app. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the Service.
